Section 1. Overview

The present “terms of sale” are concluded by:

And the buyer, a natural person, wishing to make purchases from the website www.ameliahandmade.com, hereinafter referred to as “the buyer”.

Section 2. Purpose

Amelia Handmade proposes the sale of jewellery and accessories, hereinafter called “the products”, to the users of this site.

These terms of sale aim to define the contractual relations between Amelia Handmade and the buyer, a natural person.

The acquisition of a product through this site implies unreserved acceptance by the buyer of these terms of sale, which the buyer acknowledges having read before ordering.

Before any transaction, the buyer declares that the purchase of products on the site www.ameliahandmade.com is not directly related to his professional activity and is limited to a strictly personal use, and to have the full legal capacity, allowing him to commit himself under these terms of sale.

Amelia Handmade reserves the right to modify these terms of sale at any time, to comply with any new regulation or to improve the use of its site. Therefore, the applicable conditions will be those in effect at the date of the order by the buyer.

Section 3. Products

The products offered are those listed on the website www.ameliahandmade.com, within the limits of available stocks. Amelia Handmade reserves the right to modify the range of products at any time. Each product is described on its own page, with its main technical characteristics (volume, composition, size…).

The photographs are as accurate as possible, but are not contractual. The buyer should refer to the product description.

The sale of the products presented on this site is intended for all buyers residing in countries that fully authorise the entry into their territory of these products.

Section 4. Prices

The prices displayed on the product sheets in the catalogue on this site are in Pounds Sterling (£). No tax is applicable.

Any change in the tax rate may be reflected in the price of the products. Amelia Handmade reserves the right to modify its prices at any time. However, Amelia Handmade commits itself to invoice the products at the prices indicated at the time of purchase.

The prices indicated do not include delivery costs, which are extra charged on the price of the products purchased, depending on the volume and weight of the products, the total amount of the order and the geographical area of the buyer. These delivery costs are communicated to the buyer before the order is validated.

For orders delivered outside the UK, the buyer is the importer of the products they purchase. For all products shipped outside of the UK, the invoice will be based on the price before tax. The buyer is solely responsible for the declaration and payment of any customs duties or other taxes that may be due in their country.

Products must be paid for in full when ordering. Advance payments and payments in instalments are not permitted.

Amelia Handmade may offer promotional codes, which are generated exclusively by Amelia Handmade, and which are only valid in specific cases. Only one promotional code is applicable per order. Amelia Handmade cannot be held responsible for promotional codes found outside of Amelia Handmade.

Amelia Handmade cannot be responsible for any computer problem that would modify the display of the prices. In this case, the buyer will be informed and the order will be cancelled and refunded.

Section 5: Ordering and payment terms

To place an order, the buyer must create an account or log on to the site www.ameliahandmade.com from the menu on this site or when validating the basket. At each visit, the buyer, if he wishes to order or consult his account (status of orders, profile…), must identify himself using the information entered at registration. Certain personal information, such as the buyer’s full name, address and telephone number are necessary to confirm an order and must be entered accurately.

The buyer can add the products he/she wishes to order to the “basket” from the product catalogue. The buyer can access the basket at any time and modify, if necessary, the quantities and references.

Once the products have been added to the basket, the buyer is asked to validate the basket, then to log in or register, to consult the summary, to enter the personal information necessary for delivery or to check it, and to choose the method of payment.
Shipping costs are then calculated and submitted to the buyer. Orders are sent by Royal Mail from the UK.
Amelia Handmade offers the buyer the possibility to order and pay for its products via PayPal or by credit card (via the PayPal system). The buyer must then choose the method of payment, then check all the information, read and accept these terms of sale by checking the corresponding box, to validate the order.
Finally, the buyer is redirected to the secure PayPal interface in order to safely enter his/her PayPal account or personal card details. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by PayPal account or bank card is irrevocable.

In case of fraudulent use of the buyer’s bank card, the buyer must inform his bank. Amelia Handmade cannot be held responsible in case of usurpation of identifiers and connections to customer accounts by third parties.

No other payment method or payment in instalments is allowed.

Confirmation of an order implies acceptance of these terms of sale, acknowledgement of having full knowledge of them and waiver of the right to invoke one’s own terms of sale. All the data provided and the recorded confirmation will be considered as proof of the transaction. If the buyer has correctly indicated his e-mail address when ordering, Amelia Handmade will send him by e-mail the confirmation of the registration of his order.

In case of incorrect address, failure to pay, suspicion or any other problem, Amelia Handmade reserves the right to block the order until the problem is resolved.

If, despite the vigilance of Amelia Handmade, the product ordered by the buyer is finally unavailable or not conform to the description, the buyer will be immediately informed and the order cancelled. The buyer will be fully refunded as soon as possible.

Section 6. Ownership

Amelia Handmade retains full ownership of the products sold until full payment has been received, including all taxes and charges.

Section 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area.

Amelia Handmade delivers worldwide.

Orders are sent by Royal Mail and the characteristics of the delivery service will vary depending on the buyer’s choice and geographical area.

Delivery times are given as an indication only and are dependent on the deliverer. If the delivery time exceeds thirty days from the order, the sales contract may be cancelled and the buyer reimbursed. Depending on the delivery service chosen by the buyer, Amelia Handmade can provide the buyer with a tracking number by e-mail. The buyer is delivered to his home by the deliveryman. If the buyer is absent, he will receive a notice from the deliveryman, which allows him to collect the ordered products at the place indicated on the notice of passage and during the indicated time. A signature on delivery is required. The risks related to the transport are at the purchaser’s charge from the moment the products leave the premises of Amelia Handmade. The buyer is obliged to check the condition of the packaging and the contents of the products upon delivery in the presence of the delivery person. In case of damage during transport, any protest must be made to the delivery company.

Amelia Handmade cannot be held responsible for incomplete or incorrect addresses of the buyer.

Section 8. Withdrawal and return of products

The buyer has a period of fourteen working days from receipt of the order to exercise his right of withdrawal and thus return the products to Amelia Handmade for reimbursement, excluding delivery costs. The return costs are at the buyer’s charge and are responsible for the return shipping costs.

In case of withdrawal, the buyer must contact Amelia Handmade by e-mail at contact@ameliahandmade.com or via the contact form to know the return procedure. The products must be returned in their original packaging and in perfect condition. If the products received have been worn, damaged or altered, no refund, even partial, can be made.

The right of withdrawal does not apply to personalised products.

Section 9: Conditions and time limits for refunds

The refund of the products is integral, excluding delivery costs. The refund will be made according to the payment method used at the time of purchase as soon as possible and at the latest within 30 days from the date of the right of withdrawal.

Section 10: Responsibility

Amelia Handmade, in the process of distance selling, is only bound by an obligation of means. Amelia Handmade cannot be held responsible for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service, or other involuntary problems.

Section 11. Intellectual Property

All the elements of the website www.ameliahandmade.com are and remain the exclusive intellectual property of Amelia Handmade. Under the intellectual property and copyright, any use is prohibited except for private use.

Without prior authorisation, any reproduction of the Amelia Handmade website, whether partial or total, is strictly forbidden.

Section 12. Personal data

Amelia Handmade is committed to preserving the confidentiality of the information provided by the buyer, which he/she would be led to transmit for the use of certain services. No personal data will be given to third parties, with the exception of the delivery company, which requires the transmission of certain data, such as the name, address and number of the buyer, after a purchase on the website www.ameliahandmade.com, to be able to deliver the package correctly.

The buyer has the right to access, modify and delete information concerning him. He can make a request at any time by e-mail to contact@ameliahandmade.com or via the contact form.

Section 13. Dispute Resolution

The contract is governed by the laws of England.
